
ColorInk Quest Terms & Conditions
1. Definitions
“Business Customer”: Any customer purchasing for business or professional purposes.
“Consumer”: An individual purchasing for personal use, not related to business or professional activities.
“ColorInk Quest” (also “we”, “us”): The company providing goods and services under these terms.
“Catalogue”: The list of products and services offered by ColorInk Quest.
“Force Majeure”: Events beyond ColorInk Quest’s reasonable control (e.g., government action, fire, flood, industrial disputes).
“Normal Working Hours”: 8:00 AM to 5:00 PM, Monday to Friday (excluding public holidays).
“Working Days”: Monday to Friday, excluding public holidays.
Special terms apply to Consumers, which take precedence over other terms. See Clause 13 for Consumer-specific rights.
2. Orders
All sales contracts incorporate these terms, which override any customer-supplied terms.
Business Customer orders cannot be canceled once placed, as many orders ship the same day. Consumer order cancellations are accepted as per the Consumer Protection Act.
Orders are subject to acceptance and product availability; ColorInk Quest may refuse any order.
Customers must provide accurate information and are responsible for orders placed using their credentials.
Payment cards used must be authorized and have sufficient funds.
ColorInk Quest may record calls and electronic communications for training.
3. Prices
Goods and services are invoiced at the prevailing price at order acceptance. VAT is charged as per law.
Prices may change without notice and may be adjusted for currency fluctuations.
All payments must be made in full, without deductions for taxes or duties.
4. Delivery, Title, and Risk
ColorInk Quest aims to dispatch goods by the agreed date but is not liable for delays outside its control. Customers will be notified of delays.
Business Customers may cancel orders if delivery is delayed by more than 30 days, with written notice before goods are delivered or declared ready.
Business Customers must report delivery shortages or damage within 48 hours of receipt.
Customers must accept goods during Normal Working Hours.
Delivery is complete when goods reach the customer’s nominated address; risk passes to the customer at this point.
Title to goods passes only after full payment is received.
If delivery cannot be accepted, ColorInk Quest may store, sell, or re-arrange delivery at the customer’s cost.
Proof of Delivery can be requested within 3 months of delivery.
Customers must check deliveries for discrepancies or damage and note any issues on the Proof of Delivery.
5. Payment
Payment is due upon shipment unless credit terms are agreed. Standard credit terms require payment within 30 days of invoice.
Late payments incur daily interest at 3% above the Prime lending rate and a R250 administration fee per overdue invoice.
Accepted payment methods: VISA, MasterCard, Instant EFT, or bank transfer.
Card transactions are processed securely via an approved gateway; no card details are stored on the website.
ColorInk Quest is responsible for all aspects of transactions, including sales, customer service, dispute resolution, and delivery.
6. Product Specifications
ColorInk Quest strives to supply goods as advertised but may supply minor variations if manufacturers change specifications.
If ordered goods are unavailable, alternatives of equal or superior quality may be offered at no extra cost. Customers can cancel and receive a full refund if they do not accept substitutes.
Minor pixel anomalies in display panels are industry-accepted and not grounds for replacement unless exceeding manufacturer guidelines.
All quoted page yields follow ISO/IEC standards, based on standard page coverage.
7. Trade Names and Trademarks
Trade names and marks (other than ColorInk Quest’s) may indicate compatibility rather than manufacturer origin.
8. Warranties and Returns
Special return terms apply to Consumers (see Clause 13).
Unless stated otherwise, all goods delivered in South Africa carry a 12-month manufacturer’s warranty.
For Business Customers, implied warranties are excluded to the extent permitted by law unless agreed in writing.
Services are warranted free from defects for 30 days post-completion. ColorInk Quest is not liable for faults caused by third parties or unauthorized alterations.
Goods are not sold on a trial basis; suitability should be checked before ordering.
Non-returnable goods (e.g., special price discounts) can only be returned if defective.
Unwanted products may be returned (with prior written agreement) within 14 days if unopened and in resaleable condition, subject to a 15% handling fee or R250 (whichever is greater).
Defective goods may be returned for refund or replacement within 14 days, subject to testing.
Returns must include the original invoice/order number and be packaged appropriately.
ColorInk Quest is not liable for damage during return transit; customers are advised to use insured, trackable shipping.
If goods are found working after testing, return shipping is at the customer’s expense.
Warranty claims must follow manufacturer procedures; customers may be referred directly to the manufacturer for support.
The warranty is void if goods are altered or damaged after delivery.
